South Carolina grants both fault and no-fault divorces. The no-fault divorce is based on irreconcilable differences, and the spouses must have lived separate and apart for a year before they can file.
Residency RequirementsEither spouse must be a resident of South Carolina for at least one year in order to file for a no-fault divorce. However, if both spouses are residents, the requirement is only three months.
